Building a barndominium or barn in Comal County: permitting and site work

Does Comal County require a building permit?

Comal County does not enforce a comprehensive countywide building code in the unincorporated area. Instead it issues development permits, for septic, floodplain, driveways, and fire, through the Comal County Engineer's Office, rather than framing and trade building permits. The City of New Braunfels, a home-rule city, issues building permits inside its city limits. In the city's extraterritorial jurisdiction it handles subdivision and plat review rather than building permits, so an ETJ lot does not get a city building permit but still goes through the county for septic and development.

Septic (OSSF) is the step that governs

The on-site sewage facility permit, the septic permit, is usually the binding approval for a rural Hill Country build. In Comal County it runs through the Comal County Engineer's Office (Environmental Health / OSSF). The Engineer's Office is at 195 David Jonas Drive in New Braunfels; phone (830) 608-2090. A Registered Sanitarian or engineer prepares the septic design and site evaluation, and floodplain lots also need a Floodplain Development Permit. Confirm current forms before you file.

Local detail: Where a parcel is over the Edwards Aquifer recharge zone, the septic system carries extra requirements under 30 TAC 285.40, on top of the county process: a minimum lot size of at least one acre per single-family home, no treatment or holding tank within 50 feet of a recharge feature, and no soil absorption area within 150 feet of one. The 10-acre septic exemption

The statewide 30 TAC 285.3 exemption applies in Comal County: a single-family home on 10 or more acres, the only dwelling on the tract, the system at least 100 feet from property lines, effluent kept on the tract, and the system not causing a nuisance or polluting groundwater, can be exempt from the septic permit, though it still must meet state design standards. As in Hays County, an OSSF exemption does not relieve you of the Edwards Aquifer requirements if your parcel is over the recharge zone: the 30 TAC 285.40 rules still apply, and regulated construction may still require a Water Pollution Abatement Plan under Chapter 213. Edwards Aquifer

The Edwards Aquifer recharge zone crosses Comal County, running west and southwest of New Braunfels through the area that drains Dry Comal Creek between Interstate 35 and Highway 46. New Braunfels is home to Comal Springs, the largest spring system in Texas, which underlines how sensitive this ground is and which supports several endangered species. Regulated construction over the recharge zone requires a TCEQ Water Pollution Abatement Plan, and contributing-zone land can require a Contributing Zone Plan.
